Fiona Harvey, a Scottish lawyer, has filed a $170 million lawsuit against Netflix and the creator of the hit series Baby Reindeer, Richard Gadd.
The lawsuit, filed in a California court, alleges that the streaming giant and Gadd have engaged in a blatant act of defamation, intentional infliction of emotional distress, and violations of Harvey’s right of publicity.
According to the 34-page complaint, the series, which was marketed as a “true story,” has painted a false and damaging portrait of Harvey, depicting her as a “twice convicted stalker” who “sexually assaulted” Gadd. The lawsuit claims that Netflix and Gadd told these “lies” to over 50 million viewers worldwide, “because it was a better story than the truth, and better stories made money.”
The plaintiff is seeking a staggering amount in damages, including $50 million in actual damages, $50 million in compensatory damages for “mental anguish, loss of enjoyment of life and loss of business,...

Netflix’s drama series Baby Reindeer hooked viewers from the first episode. Before the series begins, the show informs viewers that the series is based on real events.
Creator Richard Gadd based the series on his 2019 one-man show, Baby Reindeer. Later, Netflix picked it up and adapted it into the drama series fans are familiar with today.
But whatever happened to the real Martha from the show?
Baby Reindeer Creator Acknowledged Martha Was Loosely Based On A Real Woman
Although Baby Reindeer was inspired by true events, creator Richard Gadd always maintained that he took creative elements for the sake of storytelling.
“It’s very emotionally true, obviously: I was severely stalked and severely abused. But we wanted it to exist in the sphere of art, as well as protect the people it’s based on,” Gadd shared with The Guardian.
While the series definitely resonated with viewers, some of those creative liberties enraged others.

Richard Gadd's smash-hit series "Baby Reindeer" is exactly the kind of story that thrives on Netflix. Based on true events that happened to Gadd, the seven-episode drama has been one of the streamer's most discussed original offerings since its debut in April of 2024. Gadd plays a fictionalized version of himself, an aspiring comedian named Donny Dunn who is already failing to address his previous traumas when he meets a woman named Martha (Jessica Gunning), who proceeds to stalk him and the people close to him. "Baby Reindeer" is an adaptation of Gadd's award-winning one-man play that he performed at the Edinburgh Festival Fringe in 2019, so it's not like this information or the way he, as a survivor, has elected to discuss it is new.

Is Netflix sending a message about its support for Baby Reindeer?
The streaming giant has posted Jessica Gunning’s audition tape for Martha in Richard Gadd’s gripping “true story” about his experience with an alleged stalker.
The video is likely a sign that Emmy voting is around the corner, but it dropped just hours after Netflix was slapped with a $170M lawsuit by Fiona Harvey, the real-life Martha.
In the 80-second clip, Gunning reads a scene from Baby Reindeer’s first episode, in which Donny (Gadd) and Martha go for coffee and the latter erupts with anger.

The Clerkenwell Films series is expected to be competitive come awards season and Netflix said it would defend the show “vigorously” against allegations made by Harvey.

Exclusive: After Netflix got slapped with a $170M Baby Reindeer lawsuit, Deadline hears that the scandal’s blast radius has been felt on other drama projects inspired by real events.
Sources said the BBC has been fielding a surge in duty of care compliance questions in recent weeks from producers of factual dramas keen to avoid a similar crisis on their shows.
The BBC is currently working on a number of sensitive projects, including a Netflix co-production about the Lockerbie bombing and Kidnapped, a BBC3 series about the abduction of model Chloe Ayling.
Only this week, Deadline revealed that the BBC is working with Dancing Ledge Productions to tell the story of Nazanin Zaghari-Ratcliffe‘s arbitrary detention in Iran. Production begins this month.

Baby Reindeer became one of Netflix’s biggest outings this year, with the miniseries receiving praise from fans and critics alike, as well as becoming one of the service’s most streamed series. The series is actually a semi-autobiographical black comedy and a passion project by Richard Gadd, who wrote the original play and the screenplay for the series and also starred in both these works. But with the series’ rising popularity, the fans began to dig deeper into the real story behind the series, and there have been many speculations about the true identities of the characters depicted in the series.
And while Gadd urged fans not to dig deeper, many real-life people had trouble because they were identified with the characters from the series. The most prominent of these cases is that of Fiona Muir-Harvey, who, herself, claims that she is the inspiration for the character of Martha...

For many viewers, the scenes hardest to take in viral streaming cringefest “Baby Reindeer” weren’t the ones of overt stalking or abuse, but those depicting the Doa stand-up comedy of Richard Gadd’s alter ego — moments whose flop-sweating public failure seemed to stretch into tortuous infinity. Canadian feature “I Used to Be Funny” likewise hinges on a paralyzing intersection between stand-up, anxiety and depression. Mercifully, however, here it’s not the protagonist’s stage act that is the cause of massive self-doubt. Instead, it’s a host of external problems that conspire to make her incapable of performing …as well as eating, sleeping and leaving her apartment.

Fiona Harvey, known colloquially as the real “Martha” from Netflix’s hit limited series “Baby Reindeer,” has made good on a vow to sue Netflix. Harvey and her attorneys believe Netflix did not live up to a standard of care in protecting her identity. Further, Harvey says many plot points in “Baby Reindeer” are defamatory and simply untrue. She is suing for $170 million.
“Baby Reindeer” was created by Richard Gadd, who stars in the series as a version of himself. The Netflix program is an adaptation of Gadd’s one-man stage show of the same name. The title is derived from a nickname Martha (Fiona in real life) is said to have given Gadd, whose on-screen character is named Donny. In the stage show and the series, Martha stalks Donny, sexually and physically assaults him, and physically assaults his girlfriend. Martha also has a criminal record for stalking others.

Netflix has been sued over its portrayal of a woman depicted as a stalker in Richard Gadd’s Baby Reindeer.
In a lawsuit filed on Thursday in California federal court, Fiona Harvey, who claims to be the inspiration behind Jessica Gunning’s Martha, accuses Netflix of defaming her through statements in the show that she’s a twice-convicted stalker who was sentenced to five years in prison for sexual assault. The streamer and showrunners “told these lies, and never stopped, because it was a better story than the truth, and better stories made money,” the complaint states.
The lawsuit, which seeks injunctive relief, seeks at least $120 million, including the streamer’s profits from the series. It brings claims for defamation, negligence and violations of right of publicity law.

Daniel Fienberg The shift to a backloaded schedule built around a May 31 deadline for Emmy consideration has drained some of the surprise from the spring TV calendar. Viewers are growing accustomed to a glut of high-profile limited series and prestige returning shows from March to May, with the biggest titles and stars creating their own gravitational fields of self-perpetuating coverage.
Luckily, though, there’s still room for discovery. With its literary pedigree and a budget that burst off the screen in the form of astonishing evocations of 17th century Japan, FX’s Shogun had “prestige” written all over it. Yet the care taken by creators Justin Marks and Rachel Kondo to deliver this story without having it reek of appropriation and voyeurism was evident throughout. The first-ever Gotham TV Awards offered a stark contrast between the Gotham Film & Media Institute’s annual celebration of cinema. While both awards shows were founded to toast independent productions — that is, before the Gotham Awards increased their budget cap eligibility requirements in 2023 — the Gotham TV Awards felt like a strangely intimate gathering that was mostly populated by showrunners, network executives, and the Gotham TV Awards jurors, with a few actors and press sprinkled in.
Sure, it could be that it’s the first year for the awards show and thus a smaller turnout and even venue. Or perhaps the Gotham TV Awards will remain a coveted industry event, one that feels like it’s only for insiders.
The intimacy was most prominent during the Anniversary Tribute for “Law & Order: Special Victims Unit” icon Mariska Hargitay. The award was presented by Hargitay’s former co-star Stephanie March, and...

“Colin from Accounts” was the biggest winner at the 2024 Gotham TV Awards, the first ever television-only kudos from The Gotham Film and Media Institute. The Paramount+ series is an Australian import about a pair of singles brought together by a car accident. Check out the complete list of Gotham champs here.
The drama categories were split. Baby Reindeer captured the Breakthrough Limited Series award and Colin From Accounts was the only two-time winner at Tuesday’s inaugural Gotham TV Awards.
While the dress was black tie, the event moved at a remarkable clip, with barely an hour and 20 minutes required for the seven competitive awards and three career honors. Previously, the Gotham Film & Media Institute had included TV awards in its film-centric gala, which is held just after Thanksgiving as Oscar season is gearing up. This is the first year TV has had its own event.
Richard Gadd, who created and starred in Baby Reindeer, accepted the trophy on the behalf of his collaborators. As a comedian, he couldn’t resist quips about a “6-inch tall” pastrami sandwich at Katz’s Delicatessen and thanked his mom and dad for “messing me up enough to make me an artist.” But he closed his speech on a sincere note.

Baby Reindeer, Mr. and Mrs. Smith and Colin From Accounts were the top winners at the first-ever Gotham TV Awards, which took place in New York on Tuesday night.
Accepting for breakthrough limited series, the final award of the night, Baby Reindeer star and creator Richard Gadd offered a thoughtful observation about the Netflix show’s popularity and some advice for anyone going through a difficult time.
“It’s weird that a show as messed up as this has gone on to strike a chord with so many people,” Gadd said of darkly comic thriller. “I think it speaks to the fact that I think a lot of people in the world are struggling right now. I don’t know much in the way of advice, but I do know that nothing lasts forever. So if you are in a rut, just keep going. Persevere, persevere, persevere and I promise you things will get better.

“Baby Reindeer” was among the winners at the first-ever Gotham TV Awards on Tuesday evening, taking home the prize for breakthrough limited series.
“I never thought in a million years that this dark, weird, messed up show would have brought in this universal love that it’s received,” said Richard Gadd, the show’s creator and star, in his acceptance speech. He also thanked Netflix, his team and his mom and dad for “messing [him] up enough to make [him] an artist.”
Gadd went on to say, “It’s kind of weird also that a show as messed up as this has gone on to strike a chord with so many people. I think it speaks to the fact that a lot of people in the world are struggling right now. And I don’t know much in the way of advice, but I do know that nothing lasts forever. It all started with a cup of tea on the house.
That innocuous gesture between a failed comedian turned barhand named Donny (Richard Gadd) and his soon-to-be stalker, Martha (Jessica Gunning) would spark a chain of events eventually culminating in the streaming success of “Baby Reindeer” on Netflix. The small, U.K. production based on Gadd’s real-life experience all centered around the complicated chemistry between the two characters — so naturally, the stakes were high filming their first encounter.
In Variety’s “Making a Scene,” we sat down with Gadd, co-star Gunning and Tofilska to break down recreating that cup of tea that changed everything.
“It’s one of the most important parts of the show,” says series creator and co-star Gadd. “I always wanted the show to open straight away, throw you right into the deep end.”
Agrees director Weronika Tofilska, “It was really important for us that this...

You've probably heard of Baby Reindeer, a miniseries that came out on Netflix and became an instant hit on the streaming service with a 98% rating on Rotten Tomatoes.
A human tragedy, a confession, and a course in self-therapy, all contained in seven episodes, turned the soul of anyone who watched it inside out. Beginning as a black comedy, episode by episode it becomes something more — a story about pain, masculinity, self-identification, rehabilitation, and much more.
Baby Reindeer's Main Villain Wasn't Martha
The story of stalker Martha reveals, as the series progresses, a deeper trauma — rape, manipulation, and gaslighting — that the author experienced during his college years at the hands of his older "patron" and "mentor," 55-year-old screenwriter Darrien.
The author reveals the main pain of his life completely unexpectedly, even forcing the viewer to put the series aside for a few days. Against the backdrop of this episode, Martha...

Netflix approached Richard Gadd about adapting his hit one-man stage show “Baby Reindeer” into a series, but the comedian had screen aspirations for his Olivier Award winner way before that. “I always thought that it had televisual potential,” Gadd tells Gold Derby (watch the exclusive video interview above). “Even when I was writing the play, I kept thinking it has quite a lot of interesting things that would work in the television realm. I think the characters are quite interesting and it’s a thriller. It hard a sort of fast-paced breathlessness to it that I think works in the thriller genre. Firstly, I wanted it to succeed as a theater show, but in the back of my mind, I thought I hope it does go on to have a life beyond the stage for sure.”

Weronika Tolfiska, who directed the first four episodes of “Baby Reindeer,” knew exactly who she wanted to shoot the Netflix series, her friend and frequent collaborator Krzysztof Trojnar. At the time, the cinematographer was doing second unit photography for “1899” and Tolfiska, who was in the midst of interviewing herself for the show, wasn’t sure if she could interview Trojnar. “Somehow seeing the other DPs and credits that some people that were suggested for it, she said she would love to interview me and that’s how it all started,” Trojnar tells Gold Derby (watch the exclusive video interview above). “They gave me a script and once I read it, I think it was one of the best scripts I’ve read so far in my life. “Truth Serum,” a short film starring “Baby Reindeer” creator Richard Gadd, has been snapped up by Omeleto.
Directed by Vika Evdokimenko, “Truth Serum” is a comedy that follows a group of guests at a housewarming party who are slipped a mysterious drug. “When ugly truths start to emerge, chaos reigns and threatens the relationships of old friends,” reads the logline.
“Baby Reindeer” fans will no doubt enjoy seeing Gadd playing a character that is not dissimilar to the Netflix series’ Donny Dunn. Gadd’s character of Jimi is friends with the host couple; he is described as a “liability” whose “self-destructive behavior masks deep self-loathing and a secret that’s not ready to come out.”
Gadd stars alongside Olivia Vinall (“Road Kill”) as a party hostess at the end of her tether and Sophie Kennedy Clark (“The Danish Girl”) as an unreformed party girl who’s dragged her underage daughter along for the ride.

A year after the Hollywood strikes turned Emmy campaigning into a bit of a muted endeavor, For Your Consideration events are back in a big way for 2024. The networks, studios and streamers have already launched a bevy of activations to celebrate their awards contenders, on top of the usual round of panels, with their stars back on stage front and center.
What a difference a year makes. In 2023, FYC events were forced to pivot when the Writers Guild strike got underway on May 2 — right as campaigning was kicking into high gear. In most cases, series stars didn’t feel comfortable continuing with events. Then talent hit the picket lines for their own strike in mid-July, right after Emmy nominations were announced.
At that point, it was up to directors and artisans to promote their shows. “We definitely did a lot of jazz hands last year to kind of make people feel good,...

Ted Sarandos is commenting on the box office success of Oppenheimer, Barbie, and their Netflix series Baby Reindeer.
In a new interview, the Netflix CEO said that the films starring Margot Robbie and Cillian Murphy would’ve been just as big on the streaming platform.
“Both of those movies would be great for Netflix. They definitely would have enjoyed just as big an audience on Netflix,” Sarandos said in an interview with the New York Times. “And so I don’t think there’s any reason to believe that certain kinds of movies do or don’t work. There’s no reason to believe that the movie itself is better in any size of screen for all people. My son’s an editor. He is 28 years old, and he watched Lawrence of Arabia on his phone.”
Barbie and Oppenheimer, directed by Greta Gerwig and Christopher Nolan, respectively, were big box office winners.

Exclusive: Michaela Coel is no longer developing a series with links to her smash BBC/HBO hit I May Destroy You.
Three years ago, then-BBC drama director Piers Wenger revealed that Coel was working on a show that had links to the I May Destroy You universe. “It’s at relatively early stages, but I wanted to let the fans of I May Destroy You know that there is a new show coming along,” Wenger said at the time.
But speaking to Deadline last week, I May Destroy You EP Phil Clarke said Coel had toyed with various ideas for what was loosely termed “I May Destroy You 2,” before deciding against going further. Coel has previously ruled out a second series of I May Destroy You in the traditional sense.
“When Piers went public, we were all talking about it,” said Clarke. “Those were Michaela’s thoughts as well.

Baby Reindeer star Jessica Gunning says she has got Richard Gadd’s back amid a backlash against his megahit Netflix series.
Gunning told The Radio Times that she is not engaging with comments made by Fiona Harvey, the woman she played in Baby Reindeer under the name Martha.
Baby Reindeer tells the “true story” of Gadd’s experience with an alleged stalker, but Harvey denies claims made by the series and said she had not been convicted of stalking.
Harvey has told her story to Piers Morgan, The Daily Record, and others. She is now considering legal action against Netflix, Gadd, and producer Clerkenwell Films.
Gunning said she was concerned about the impact Harvey’s interviews might be having on Gadd, whom she described as a “survivor” of sexual assault and stalking.

The woman purported to be the “real-life” Martha from the hit Netflix show Baby Reindeer reportedly sent the U.K.’s Labour party leader Keir Starmer 276 emails in less than eight months, according to British tabloid The Sun, which published some of what it claims are the emails.
Fiona Harvey, believed to be the real-life woman who allegedly stalked and harassed series creator Richard Gadd across thousands of emails alongside turning up at the pub he worked at and comedy gigs he performed, recently found herself in the hot seat on Piers Morgan Uncensored. She claimed to have never contacted Gadd by phone and alleged that he had asked to sleep with her, which she turned down.
Harvey has also said she will be suing Netflix for what she called the “work of fiction” penned and performed by Gadd, and that she had received death threats since the program that she calls “defamatory” aired.

“Baby Reindeer,” the Netflix series that has taken the world by storm since dropping last month, boldly opens with the claim that “This is a true story.”
“Baby Reindeer” is a brutal account of former comedian Richard Gadd’s life in his twenties as he attempted to conquer the world of entertainment. In the process, he is sexually assaulted by a senior figure in the comedy world and harassed by a stalker he met while working in a pub. In a letter seen by Deadline, Nicolson asked Benjamin King, Netflix’s senior UK director of public policy, to provide evidence of Harvey’s criminal record after he told the committee that Baby Reindeer was a “true story of the horrific abuse” suffered by Gadd “at the hands of a convicted stalker.”

Fresh from his bombshell interview with ‘the real Martha,’ Piers Morgan has slammed “high-profile people in the business” who have said they know the identity of Richard Gadd’s abuser portrayed in Baby Reindeer.
Along with the furious guessing game to find Gadd’s female stalker sparked by the controversial Netflix series, the internet has been ablaze with sleuths trying to discover the identity of the comedy producer portrayed in episode 4 who grooms, sexually assaults and rapes Gadd. One director has even taken legal action against those targeting him as ‘the real Darrien’. Darrien is played by Tom Goodman-Hill in the show and returns in later episodes.
Some have revealed they are aware of the real abuser’s identity, including Rest is Entertainment host Richard Osman, who claimed recently that “everyone” in the industry is aware and that Gadd has been “very open to people in the industry” about the person who sexually assaulted him.

It’s searing television and, as a result, “Baby Reindeer” is one of the most acclaimed shows of the year.

Some people run away by packing their bags. Others run away by standing in one place for too long. Others don’t run away at all. And that’s just what Fiona Harvey – who says she is the inspiration for Martha in Baby Reindeer – is refusing to do, pressing forward with her lawsuit against Netflix.
The lawsuit stems partly from Netflix allegedly making no attempt to contact Harvey leading up to and after Baby Reindeer becoming a hit for the service. Chris Daw Kc, a barrister working with Harvey, said that the series also grossly misrepresented her persona and past, thus profiting from false portrayals. “Portraying someone as a convicted criminal who has done time in prison, when that is not true, is a pretty clear cut case of defamation, as it is bound to cause serious harm to that person’s reputation…There are strict laws on the use...
