A judge dismissed charges against seven men accused of kidnapping a record producer who claimed he had a sex tape of the recently-retired NBA star, Shaquille O'Neal.
Robert Ross, a record producer and alleged victim, claimed to have possession of a sex tape featuring Shaq with several woman over the course of his marriage to Shaunie O'Neal. He says he told Shaq about the sex tape during a business dispute and then two weeks later he was abducted, assaulted and robbed by seven gang members at the request of the basketball player.
However, Tuesday (August 9) in court the judge threw out the case after the District Attorney stated he no longer found Ross' testimony credible.
Ross also admits he had no such sex tape. Shaq had denied the existence of the tape from the beginning.

A Los Angeles judge has dismissed charges against alleged gang members accused of kidnapping a record producer who boasted of owning a sex tape featuring retired basketball superstar and rapper Shaquille O'Neal.
Prosecutors told Superior Court Judge M.L. Villar de Longoria they no longer wanted to proceed with the trial, citing problems with the credibility of the alleged victim, Robert Ross.
Ross, a former gang member, claimed he was assaulted and robbed during the 2008 kidnapping.
He accused gang members of taking him to a home and beating him while demanding the videotape, according to the Los Angeles Times.
Ross also filed a civil lawsuit against O'Neal and a business partner, claiming the two men were behind the attack.
Prosecutors told Superior Court Judge M.L. Villar de Longoria they no longer wanted to proceed with the trial, citing problems with the credibility of the alleged victim, Robert Ross.

Shaquille O'Neal's sex tape becomes talk of the town this weekend after his former friend, who claimed to have possessed it, testified in court for kidnapping, robbery and conspiracy by seven Main Street Crip members. In addition, the NBA star's ex-wife Shaunie also confirmed that she was offered the sale of the tape.
Robert Ross said Shaq often brought women to his home and the security camera captured all. "He was at my house with some girl and it was on tape," Ross said as quoted from a transcript released Saturday, June 18.
Deputy Dist. Atty. Chun then asked, "So did you really have a video of Shaq or had it already been recorded over?" Ross replied, "It was over. It was gone." Ross is expected to continue his testimony when the hearing resumes July 6.
Meanwhile, Shaunie said that she rejected a copy of the sex tape when Ross and her had a meeting.
