Charlie Sheen's ex-wife Brooke Mueller is free to return to California just days after being arrested in Aspen, Co on assault and drug charges according to the Aspen Daily News. She is required to return to court Dec. 19.
Mueller's attorney Richard Cummins filed a motion on Monday (Dec. 5) that the she be permitted to return to Los Angeles to care for the two boys she has with Sheen. The former "Two and a Half Men" actor was granted temporary custody of the children following Mueller's arrest.
The whole problem for Mueller started over the weekend when she was arrested after allegedly assaulting a woman during a concert. According to Arnold Mordkin, chief deputy district attorney, Mueller had between 4 and 5 grams of cocaine on her at the time of her arrest.
Mueller's no stranger to the Aspen police. It was on Christmas 2009 Mueller called the police saying that Sheen assaulted her.

An attorney for Charlie Sheen has reportedly filed a motion to request that Sheen's statements to police, related to an alleged Christmas Day domestic violence dispute involving his wife Brooke, be thrown out. The Associated Press reports that defense attorney Richard Cummins filed the motion on April 1, claiming that the officer that questioned Sheen did not appropriately advise him of his legal rights. Sheen has pleaded not guilty to menacing, criminal mischief and assault charges. A jury trial is scheduled for July 21, according the AP.

Brooke Mueller underwent emergency surgery on her wisdom teeth earlier this week and was hospitalised when an infection set in. She was admitted on Wednesday, reportedly suffering from a bout of pneumonia.
