Los Angeles prosecutors told a judge Tuesday that they will not retry Harvey Weinstein, who was convicted of the rape and sexual assault of one woman, on counts involving two others that left jurors deadlocked.
Deputy District Attorney Paul Thompson announced the decision to Superior Court Judge Lisa B. Lench at a hearing in downtown Los Angeles. The judge granted a defense motion to dismiss the charges and said Weinstein would be returned to New York, where he was convicted in a similar case.
Weinstein attorney Jacqueline Sparagna said he maintains his innocence of the charges.
In December, the Los Angeles jury convicted Weinstein, 70, of the rape and sexual assault of Italian model and actor Evgeniya Chernyshova, and he was sentenced to 16 years in prison. That’s in addition to the 23-year sentence he is already serving in New York.

Harvey Weinstein’s genitalia has frequently been addressed in open court throughout his trial. But in the final hours of the case, the former movie producer’s abnormal testicles emerged as a key piece of evidence on which the jury will have to deliberate when they determine whether he is guilty of rape and sexual assault.
During the trial, prosecutors revealed to the jury that Weinstein underwent surgery in 1999 for Fournier’s gangrene, which required doctors to remove some of his scrotum, reports Variety.
“That surgery caused pretty noticeable scarring. Because of an infection, his testicles were actually taken from his scrotum and put into his inner thighs,” the lead prosecutor, Deputy District Attorney Paul Thompson, told the jury at the beginning of the trial.

Nutter was working with the model and actor – who is known in the case as Natassia M. – on a commercial in 2007 or 2008. The Los Angeles trial is expected to last a total of two months, heading into December. On Thursday, the jury was told they would reconvene after Thanksgiving when the defense begins with its case on Nov. 28.
Weinstein — who was already convicted in New York and is in the midst of serving his 23-year sentence — is facing seven charges in the sprawling Los Angeles case: two charges of rape and five counts of sexual assault. On these counts, he faces 60 years, if convicted.
Originally, Weinstein was facing 11 charges and a maximum sentencing of 140 years. Jane Doe #5, who was associated with these charges, is no longer part of the case, so Weinstein won a motion for four charges to be dismissed. Prosecutors said earlier this week that they would not proceed with testimony from Jane Doe #5, but offered no explanation.

A model-actress who has accused Harvey Weinstein of sexual assault finished her testimony on Wednesday, as she faced a contentious cross-examination from a defense attorney who tried to raise doubts about her version of events.

But he noted that in an interview with Los Angeles Police Detective Javier Vargas, she said that the concierge called saying that Weinstein wanted to see her and then put him on the phone.
He also questioned her on whether she ever confronted the hotel about “this terrible breach of protocol” in that, presumably, they let Weinstein know what room she was staying in.

Harvey Weinstein was a serial predator who used business meetings to sexually assault women over the course of decades, according to prosecutors in the former Hollywood mogul’s L.A. trial, which began opening statements on Monday morning.
Weinstein’s defense team will deliver their opening statement to the jury on Monday afternoon, and will likely paint a very different picture of their client, who denies all wrongdoing, and is facing 11 charges stemming from the accounts of five women whose allegations span from 2004 to 2013.
Weinstein is already serving a 23-year sentence from his New York rape and sexual assault conviction in 2020. If convicted in the current Los Angeles trial, Weinstein could be behind bars for life.

Los Angeles prosecutors launched their rape case against Harvey Weinstein on Monday with an opening statement that included detailed descriptions of the eight accusers who will testify in the criminal trial, as well as several graphic examples from their recollections.
“You’re going to hear from eight different women who were assaulted by Harvey Weinstein in Los Angeles,” said Deputy District Attorney Paul Thompson. Four are from Los Angeles, and the other four from outside the area, he said, adding that they each came forward independently.

Paul Thompson, a prosecutor in the Los Angeles County D.A.’s sex crimes unit, is leading the case against Harvey Weinstein, which got underway on Monday morning.
But Thompson was not initially assigned to the case. The case was originally given to Lowrie Mendoza, a deputy district attorney who has prosecuted sex crimes for the last 14 years.
She and her boss, Christina Buckley, were both removed from the case in 2019 out of concern that they had been told of a confidential email between Weinstein and his defense lawyer, according to court declarations reviewed by Variety. An LAPD detective, Javier Vargas, was also removed from the case because he read the attorney-client email, according to the declarations.
Removing them would eliminate the possibility that an appeals court would later overturn a conviction due to that issue.

A short film which began with Fusetti’s fascination with text-to-image AI software, it quickly evolved into a full-fledged project where Fusetti would use such imagery on the canvas of an interpretative dancer to tell a story that covers the history of human life. Clocking in at a little over two minutes, Fusetti’s film packs a sensory overload of colourful particles and textures that soar through space and time. Directors Notes invited Fusetti to join us in conversation, as Generation arrives online, to talk about his keen interest in overwhelming the viewer with images, the decision to centre his experimental short on a human element, and the lengthy post-production journey it took to manifest the film into existence.
