In what was one of a number of acidic exchanges today between lawyers, that’s what clearly heated Rust Special Prosecutor Kari Morrissey told a virtual hearing today on a motion by Alec Baldwin’s defense to see the involuntary manslaughter charges against their client dismissed
Despite his lawyers’ best efforts Friday over the long hearing, Baldwin will not know for several more days if he is still going to stand trial this summer on involuntary manslaughter charges for the fatal 2021 shooting of Rust cinematographer Halyna Hutchins.
Late this morning, Judge Mary Marlowe Summer told the assembled attorneys that she will make public next week her decision on whether or not to dismiss the indictment. “I’ll put it in writing, look for that,” she said, wearily signing off.

Hannah Gutierrez-Reed will remain behind bars as the Rust armorer awaits sentencing on her involuntary manslaughter conviction, a New Mexico judge ruled today.
“Keep in mind there was a death that the jury determined was caused by her so I’m not releasing her,” said Judge Mary Marlowe Sommer in a virtual hearing on motions filed by Gutierrez-Reed’s defense team for her release and a new trial.
The new trial effort was also shut down by Judge Sommer on Friday.
After a two-week trial, Gutierrez-Reed was found guilty on Match 6 of involuntary manslaughter in the fatal October 21, 2021 shooting of cinematographer Halyna Hutchins on the set of the indie Western. The jury, made up of seven women and five men, found the ex-armorer not guilty of the charge of evidence tampering. After a trial that lasted almost two weeks, it took a jury three hours to return a guilty verdict for involuntary manslaughter against Hannah Gutierrez-Reed, the armorer on “Rust.” After an investigation of cinematographer Haylna Hutchins’ death that took more than two years, it was a swift end. One case remains: Alec Baldwin, who held the gun that killed Hutchins on October 21, 2021.
Baldwin’s trial is set for July and it carries the same involuntary manslaughter charge. Like Gutierrez-Reed, he faces up to 18 months in prison if convicted. Gutierrez-Reed currently awaits sentencing while in custody.
Neama Rahmani, founder of Los Angeles-based personal injury firm West Coast Trial Lawyers and a former federal prosecutor, said he believes Baldwin’s case will be much harder to prosecute — but Gutierrez-Reed’s conviction only helped his case.
“It’s a win-win for Baldwin,” Rahmani told IndieWire. “The prosecution has proven that she’s responsible.

Rust armorer Hannah Gutierrez-Reed has been found guilty of involuntary manslaughter over the accidental shooting death of cinematographer Halyna Hutchins.
But in a split verdict Wednesday, a 12-member jury in Santa Fe declined to convict her on evidence tampering charges. Jurors returned the decision after less than three hours of deliberating.
The 26-year-old Arizona woman faces up to 18 months in prison for her role in the death of Hutchins. She was remanded into custody after the verdict was read.
The shooting occurred Oct. 21, 2021, when an old-fashioned revolver being handled by Alec Baldwin went off while he was practicing drawing the prop firearm. Prior to that, assistant director David Halls handed Baldwin the weapon and said that it did not contain live ammunition, but it discharged in the direction of Hutchins, who was killed, and director Joel Souza, who was injured. Five live rounds mixed in with dummy rounds were found on set following the shooting.

Hannah Gutierrez Reed, the armorer on the ill-fated Western film “Rust,” was convicted on Wednesday of involuntary manslaughter in the death of the film’s cinematographer.
Jurors returned a verdict after less than three hours of deliberations on Wednesday afternoon, following two weeks of testimony about safety lapses on set.
Gutierrez Reed was acquitted of a separate charge of tampering with evidence. She faces up to 18 months in prison at sentencing, which is expected sometime in April.
Following the verdict, Judge Mary Marlowe Sommer ordered Gutierrez Reed remanded into custody. As her attorney, Monnica Barreras, rubbed her back to comfort her, bailiffs led her away.
Outside the First Judicial District courthouse in Santa Fe, N.M., juror Alberto Sanchez told reporters that the jury reached a “fair” verdict.
“Someone died,” Sanchez said. “You gotta take responsibility. Especially when you’re handling weapons and you’re in charge of those. That’s your job.

Attorneys gave their closing arguments in the “Rust” trial in Santa Fe, N.M., on Wednesday, with the prosecution urging jurors to find Hannah Gutierrez Reed guilty of involuntary manslaughter and to hold her accountable for an “astonishing” lack of gun safety on the film set.
Special prosecutor Kari Morrissey argued that as the film’s armorer, Gutierrez Reed, was in charge of guns on set, and that it was her failure to tell the difference between dummies and live rounds that led to the death of cinematographer Halyna Hutchins.
“This was a game of Russian roulette every time an actor had a gun with dummies,” Morrissey said.
Defense attorney Jason Bowles urged the jury to find her not guilty.
He cited flaws in the Sheriff’s investigation that made it impossible to know for certain where the live rounds came from. He also pointed to errors committed by the production,...

Updated, 12:18 Pm: “Justice for Halyna does not mean injustice for Hannah,” defense lawyer Jason Bowles told the jury Wednesday in Rust armorer Hannah Gutierrez-Reed’s involuntary manslaughter trial for the killing of cinematographer Halyna Hutchins on October 21, 2021.
Now that both the defense and prosecution closing statements have concluded, the case has just gone to the jury for deliberations. Read more about the prosecutors’ summary below.
“It’s extremely important the government rule out every reasonable doubt because that is our standard in this country,” Albuquerque attorney Bowles told the Santa Fe courtroom in his closing argument. “Hannah is a scapegoat for all the management failures.”

Santa Fe, N.M. — The director called “action,” and Alec Baldwin emerged from a wooden shed and advanced toward the camera, firing shots from an old pistol. As soon as he heard “cut,” the actor wanted to do the take again.

Santa Fe, N.M. — The “Rust” trial boiled over in hostile bickering between the prosecution and the defense on Wednesday, after the defense poked several holes in the Sheriff’s investigation.
Hannah Gutierrez Reed, the film’s armorer, is on trial for involuntary manslaughter in the October 2021 death of cinematographer Halyna Hutchins. The prosecution has argued that Gutierrez Reed unwittingly brought live ammunition on set.
Cpl. Alexandra Hancock, the lead investigator on the case for the Santa Fe County Sheriff’s Office, testified Wednesday that there is no “direct” evidence of that theory — only circumstantial evidence.
In his opening statement, prosecutor Jason Lewis argued that photos show that Gutierrez Reed had the live rounds on set as early as Oct. 10 — 11 days before the shooting — and failed to notice them.
But on cross-examination, Hancock agreed that she had “no idea” when the live rounds came on set.

Santa Fe, N.M. — “Rust” armorer Hannah Gutierrez Reed told detectives that she brought dummy rounds to set that were left over from a previous film, and that had been loose in a bag in her car.
Gutierrez Reed is on trial for involuntary manslaughter in the death of Halyna Hutchins, who was killed by a live round fired from Alec Baldwin’s gun. Prosecutors have alleged that Gutierrez Reed was responsible for bringing a box of dummies that included multiple live rounds.
On Tuesday, jurors were shown a police interview from November 2021, in which Gutierrez Reed said that she had used dummies on “Rust” that were left over from “The Old Way,” a Nicolas Cage film she had worked on a few weeks earlier.
“I went back through a bag that I had,” Gutierrez Reed said in the interview. “This bag had a bunch of loose dummies in it.

Santa Fe, N.M. — A crew member on “Rust” gave jurors a tearful account Monday of the fatal shooting on set, and laid much of the blame on Hannah Gutierrez Reed, the film’s armorer.
Ross Addiego, the dolly grip, became choked up and cried at several points as he recalled the events surrounding the death of cinematographer Halyna Hutchins.
He also faulted Gutierrez Reed for leaving guns and ammunition unsecured, saying she was nothing like the “uptight,” “anal retentive” armorers he had encountered over his 30-year career.
“She wasn’t necessarily as serious or professional as I am accustomed to with the other armorers that I’m familiar with,” Addiego testified. “I don’t know that I’ve ever seen an armorer pull loose ammo out of a fanny pack.”

“She wasn’t necessarily as serious or professional as I am accustomed to with the other armorers that I’m familiar with,” Addiego testified. “I don’t know that I’ve ever seen an armorer pull loose ammo out of a fanny pack.”

Alec Baldwin will face a New Mexico jury this summer on involuntary manslaughter stemming from the 2021 fatal shooting of Rust cinematographer Halyna Hutchins.
As promised last week, Judge Mary Marlowe Sommer today set a date for the start of the multiple Emmy winner’s trial in the Land of Enchantment. Baldwin faces a prison sentence of 18 months to three years and around $5,000 in fines if found guilty.
“Jury selection is scheduled for July 9, 2024” wrote Judge Sommer in an order made public Monday morning (read the Baldwin trial scheduling order here). With Baldwin present in the Santa Fe courtroom, the trial is expected to run from July 10 to July 19, 2024.
Aways denying he pulled the trigger, Baldwin shot Hutchins on October 21, 2021 on Rust‘s Bonanza Creek Ranch set just outside Santa Fe after a gun he was holding during a rehearsal discharged a live round. The actor/producer wounded Rust director Joel Souza in the shooting too,...

Santa Fe, N.M. — The trial of “Rust” armorer Hannah Gutierrez Reed began Thursday with prosecutor Jason Lewis arguing that her “sloppy” and “unprofessional” conduct led to the death of the film’s cinematographer.
In his opening statement, Lewis argued that Gutierrez Reed had twice failed to properly check ammunition that she loaded into Alec Baldwin’s gun.
The cinematographer, Halyna Hutchins, was killed when Baldwin fired a live round during blocking for a scene in October 2021.
“The defendant treated the safety protocols as if they were optional rather than as if people’s lives counted on her doing her job correctly,” Lewis argued. “By failing to make those vital safety checks, the defendant acted negligently and without due caution. The decision she made that day contributed to Ms. Hutchins’ death.”
Gutierrez Reed is on trial for involuntary manslaughter and evidence tampering. She faces up to three years in prison if convicted.

Hannah Gutierrez Reed is charged with involuntary manslaughter in the death of cinematographer Halyna Hutchins in October 2021. Prosecutors allege she displayed criminal negligence when she accidentally loaded a live round into Alec Baldwin’s gun. Hutchins was shot when the gun fired during preparation for a scene at the Bonanza Creek Ranch near Santa Fe, N.M.
Gutierrez Reed has also been charged with tampering with evidence, for allegedly handing off a bag of cocaine to someone else on the day of the shooting. If convicted of both charges, she faces up to three years in prison.

A New Mexico judge has advanced the criminal case against Rust armorer Hannah Gutierrez-Reed, marking a win for the prosecution, which has been marred by setbacks.
Judge Mary Sommer on Tuesday rejected a move to dismiss the case by Gutierrez-Reed, who argued that prosecutors tainted the investigation to the point a fair trial is no longer possible, didn’t have the authority to bring charges and that her due process rights were violated. The weapons supervisor who loaded the gun on the set of the movie before handing it to star/producer Alec Baldwin — who was holding it when it discharged during a rehearsal, killing cinematographer Halyna Hutchins — will face a weeklong hearing starting on Aug. 9 to decide if there’s probable cause for the case to go to trial.

A Santa Fe judge on Tuesday denied a defense motion to throw out the “Rust” prosecution, keeping the case on track for a key hearing that begins next week.
Hannah Gutierrez Reed, the film’s armorer, faces charges of involuntary manslaughter and tampering with evidence. She is accused of loading a live round into Alec Baldwin’s gun on Oct. 21, 2021, leading to the shooting death of the film’s cinematographer, Halyna Hutchins.
If convicted on both counts, Gutierrez Reed faces up to three years in prison.
Her lawyer, Jason Bowles, filed a motion to dismiss the case, citing a series of irregularities and missteps by the prosecution. Prosecutors have already dropped charges against Baldwin, after learning that the gun may not have been functioning properly at the time of the shooting.
But at a brief hearing on Tuesday, Judge Mary Marlowe Sommer rejected the defense motion.

Updated with lawyer statement: Prosecutors in New Mexico say Rust armorer Hannah Gutierrez-Reed, who faces an involuntary manslaughter charge in the 2021 shooting death of cinematographer Halyna Hutchens on the set of the indie Western, attempted to hide a small bag of cocaine the night of the fatal shooting after she was questioned by police.
The claim comes in a new filing from special prosecutors Kari Morrissey and Jason Lewis, who last week added a charge of tampering with evidence against Gutierrez-Reed, saying she “did transfer narcotics to another person with the intent to prevent the apprehension, prosecution or conviction of herself.” The type of drug was not ID’d at the time.
The revelation came in a motion (read it here) on Thursday afternoon by prosecutors seeking to protect the identity of a witness who will testify about the drug transfer, saying the witness has concerns about “being subject to...

Prosecutors in the “Rust” shooting case accuse Hannah Gutierrez-Reed, the film’s armorer, of handing off a bag of cocaine to another person in an attempt to conceal it from authorities, after Alec Baldwin shot a live bullet that killed cinematographer Halyna Hutchins, according to a Thursday court filing viewed by the Santa Fe New Mexican.
The new filing specifies cocaine as the drug that Gutierrez-Reed attempted to dispose of, following last week’s charge of evidence tampering brought by prosecutors in the ongoing case. Gutierrez-Reed is also facing an involuntary manslaughter charge, the same accusation initially made against Baldwin, though his charges have been dropped.
Prosecutors Kari Morrissey and Jason Lewis said a confidential witness will testify that Gutierrez-Reed passed the cocaine off to someone else after being interviewed by the police the night of the shooting.

The weapons supervisor charged with involuntary manslaughter in the shooting death of a cinematographer on the New Mexico set of the Alec Baldwin film “Rust” was charged Thursday with evidence tampering for allegedly passing drugs to someone else on the day of the shooting.
Hannah Gutierrez-Reed “did transfer narcotics to another person with the intent to prevent the apprehension, prosecution or conviction of herself.” the special prosecutors appointed in the case said in a Santa Fe County court filing. They gave no further details.
Gutierrez-Reed’s attorney Jason Bowles called the move “retaliatory and vindictive.”
“It is shocking that after 20 months of investigation, the special prosecutor now throws in a completely new charge against Ms. Gutierrez Reed, with no prior notice or any witness statements, lab reports, or evidence to support it,” Bowles said in a statement.

Hannah Gutierrez-Reed, the Rust armorer who has been charged with involuntary manslaughter in the October 2021 death of Halyna Hutchins on the New Mexico set of the indie Western, now faces a second charge: tampering with evidence.
The special prosecutors in the case said Thursday in a court filing that the second count alleges “the above-named defendant did transfer narcotics to another person with the intent to prevent the apprehension, prosecution or conviction of herself.”
No other details were provided. Like the involuntary manslaughter charge, the new charge is a fourth-degree felony.
Gutierrez-Reed’s defense team today filed a new motion (read it here) to dismiss the two charges, with attorney Jason Bowles citing a letter sent by the New Mexico District Attorney’s lead investigator in the case raising questions about “the conduct of the Santa Fe Sheriff’s Office during and after their initial investigation.”

That’s four for four setbacks for the New Mexico First Judicial District Attorney in her prosecution of Alec Baldwin for the fatal shooting of Rust cinematographer Halyna Hutchings in October 2021.
In a virtual hearing today, Judge Mary Marlowe Sommer shut down D.A. Mary Carmack-Altwies’ attempt to bring on a new special prosecutor for the high-profile case and serve as co-counsel in the matter.
“We need extra manpower on this case,” the elected official told the judge and lawyers for Baldwin and co-defendant and ex-Rust armorer Hannah Gutierrez-Reed Monday. “All the money in the world doesn’t help prosecute a case if we can’t find the bodies in our office,” Carmack-Altwies went on to say, noting the loss of nearly a third of her prosecution team over the last few years.
“We are in dire straits,” she bluntly noted on the remote gathering, that included Reed herself.

A judge on Monday blocked the Santa Fe district attorney from appointing a new prosecutor in the “Rust” case, marking another setback for the prosecution.
Mary Carmack-Altwies, the elected D.A., said at a hearing Monday that the office is in “dire straits” due to a manpower shortage, and needs an outside lawyer to help prosecute Alec Baldwin and armorer Hannah Gutierrez Reed for the October 2021 death of cinematographer Halyna Hutchins.
But Judge Mary Marlowe Sommer ruled that the D.A. could not appoint a “special prosecutor” unless the D.A.’s office plans to recuse itself entirely from the case.
“You cannot use it unless you’re not going to prosecute,” the judge said.

‘Rust’ armourer Hannah Gutierrez Reed is seeking to block the appointment of a new prosecutor in her involuntary manslaughter case, after the first one resigned.
Gutierrez Reed and actor Alec Baldwin have both been charged in the death of Halyna Hutchins, the cinematographer who was accidentally shot on set in October 2021, reports ‘Variety’.
In a brief filed on Friday, Gutierrez Reed’s lawyer argued that Santa Fe District Attorney Mary Carmack-Altwies is misusing the New Mexico statute that allows for the appointment of an outside prosecutor.
“The statute is not designed to give district attorneys a taxpayer-funded supplemental ‘war chest’ to prosecute cases involving ‘high profile’ actors or individuals,” wrote defence lawyer Jason Bowles.
The original prosecutor, Andrea Reeb, stepped down two weeks ago after Baldwin’s lawyers argued that she could not simultaneously serve as a legislator.
Reeb, a Republican state representative, has denied that political considerations played a role in the case.
